Until now, the provision of medical aids to around 20 million people with statutory health insurance each year was reserved for the tender winners – this also included the provision of electrical stimulation devices. The Appointment Service and Care Act (TSVG), which includes regulations on appointment referrals, minimum consultation hours and electronic patient files, has now heralded the end of tenders for medical aids.

The aim of the TSVG is “[…] to provide all people with statutory health insurance with equal access to outpatient medical care by reducing waiting times for appointments, expanding the range of consultation hours and improving the remuneration of services provided by panel doctors.” Section 19b of the licensing regulations for panel doctors increases the minimum consultation hours from 20 to 25 hours per week, including home and house calls. In addition, it is stipulated that primary care doctors – such as GPs, pediatricians, orthopaedists, ENT specialists, ophthalmologists and gynaecologists – must offer 5 hours a week as open consultation hours.
The remuneration of these additional services is improved by Section 87a. For example, doctors receive extra-budgetary remuneration for successfully arranging an urgent specialist appointment, acute services for patients who are referred via the appointment service or for services provided in open consultation hours or when the patient presents for the first time.
The aim of improving patient care also goes hand in hand with the new regulations on the provision of remedies. Blanket prescriptions will be introduced, allowing physiotherapists, occupational therapists and speech therapists to decide for themselves on the selection, duration and frequency of treatment for certain indications.
At the same time, the TSVG places the provision of assistive technology – for example with electrical stimulation devices – on a qualitative basis: The provisions in Section 127 (1), (1a) and (1b) of the German Social Code that were previously relevant to tendering will be deleted, and existing tendering contracts have been granted a six-month expiry period until November 30. In future, contracts should form the basis for high-quality patient care. With the return to quality competition, prescribers and patients can once again rely on service and product quality in the provision of medical aids.1
